Local Government Act 1989

The Greater City of Geelong Council (“the Council”), acting in accordance with section 206 (1) and 223 and Clause 3 of Schedule 10 of the Local Government Act 1989 (“the Act”), proposes to discontinue part of Hope Street, Geelong (Part Lot 1 TP555343J) measuring approximately 9.1m in lengths as shown as marked on the plan. This spur of Hope Street, Geelong is currently in private ownership. Once discontinued the land will be sold to the owner of the adjoining property and consolidated with their title.

Notice is given pursuant to sections 204(1) and 223 of the Local Government Act 1989 (“Act”) that the Greater City of Geelong Council (‘the Council”) proposes to declare Hope Street as hatched on the plan as a public highway.

Part of Lot 1 TP555343J is considered to be a public highway at common law having been maintained by the Council and is on the Council’s Municipal Public Road Register under the Road Management Act 2004. The proposal is to put this public highway status beyond doubt.

SUBMISSION PROCESS

In accordance with section 223 of the Act, any person may make a submission to the Council on the proposed road discontinuance. All submissions will be considered. If a person requests to be heard in support of their submission they must include their request to be heard in the written submission and this will entitle them to appear either personally or by a person acting on their behalf, before a Submissions Review Panel.
