Overview

Proposed road discontinuance and transfer of unmade road adjoining 137-167 Cox Road, Norlane.

The Greater Geelong City Council (City) proposes to discontinue and transfer the land within the privately owned road reserve within the property adjoining 137-167 Cox Road, Norlane, (shown shaded purple on plan below) in accordance with section 223 of the Local Government Act 1989 and section 114 of the Local Government Act 2020.

The land is part of Certificate of Title volume 8697 folio 911 and is described as Bates Road in the 1969 plan of subdivision. However, it is privately owned land and is not a road on the plan of subdivision. It is not a constructed road or included in the Municipal Road Register.

The property owner intends to redevelop the land for residential purposes which will include new roads. The road status will need to be removed from the land to enable the subdivision to be registered with Land Use Victoria.

The proposed road discontinuance will convert the land to unencumbered free hold land owned by the Greater Geelong City Council. The land can then be transferred back to the current owner of the land as a sale for a nominal value in accordance with section 114 of the Local Government Act 2020. The City will be reimbursed for expenses incurred in this transaction.

The City now invites you to make a submission on the proposed road discontinuance and sale of the land.

Submission details

In accordance with section 223 of the Local Government Act 1989 and Council's Community Engagement Policy, submissions are invited on the proposed road discontinuance and transfer of unmade road adjoining 137-167 Cox Road, Norlane. All submissions will be considered.

If any person wishes to be heard in support of their submission, they must include their request to be heard in the written submission. This will entitle them to appear either personally, or by a person acting on their behalf, before a Submissions Review Panel. The date, time and location of the panel hearing will be advised.
