Council adopts Governance Rules and Public Question and Submission Time Policy

Council adopted the Governance Rules and Public Question and Submission Time Policy at its August 2022 meeting, following a period of community engagement.

The Regulatory Legislation Amendment (Reform) Act 2022 provided for changes to the Local Government Act (Vic) 2020 allowing for meetings to be conducted by electronic means.

The Governance Rules and Public Question and Submission Time Policy were reviewed to ensure compliance with these new provisions.

Three submissions were received during the community consultation however no changes were proposed to the Governance Rules or Policy.

At the meeting, Council committed to a more comprehensive review of the Governance Rules in 2023.

OVERVIEW

The Regulatory Legislation Amendment (Reform) Act 2022 received Royal Assent on 29 March 2022. This legislation will result in changes to Division 2, Part 3 of the Local Government Act 2020 (the Act) relating to procedures for Council decision making, including the holding of Council meetings.

The changes replace the temporary emergency (COVID) provisions that allowed for conducting meetings by electronic means.

The Governance Rules and Public Question and Submission Time Policy have been reviewed and updated to ensure compliance with the new provisions.

Council endorsed drafts of the updated Governance Rules and Public Question and Submission Time Policy at the meeting 28 June 2022 allowing for community consultation until 20 July 2022.

Council will consider adopting these policies before 2 September 2022 to align with the new provisions of the Act and to consider feedback received through this consultation.

The community is invited to have its say on the draft documents for the next three weeks before finalising the documents.

The draft Governance Rules have been updated to address legislative changes to allow for Council meetings to be conducted by electronic means of communication, including the process for requesting and approving the conduct of meetings by electronic means.


Public Question and Submission Time is provided at the start of a Meeting to enable members of the public to ask questions or make submissions to Council. The Policy provides the rules and guidelines as to how this is to occur. The draft Policy has been updated to ensure compliance with legislation and reflects the previous policy prior to COVID pandemic.
